Wal-Mart worker fired after 18 years for turning in $350 cash found in Niskayuna store parking lot too slowly

He was called into a manager's office, interrogated and terminated for "gross misconduct."

His offense? He waited about 30 minutes before he turned in the money.

"The only thing I did wrong was hesitate," Walsh said, who is 45. "I didn't steal anything. They didn't give me any warning. They just fired me."

The firing happened on the same day that Thomas Smith, 52, of Albany, an East Greenbush Wal-Mart employee, was fired for redeeming $2 worth of cans and bottles left behind in a shopping cart.

Worker rights advocates are organizing a Wal-Mart boycott through Jan. 1 and additional East Greenbush store demonstrations in response to Smith's controversial termination.

In the Niskayuna incident, a manager at the store, located on State Street in Mansion Square, said Tuesday she could not discuss Walsh's firing. A Wal-Mart spokesman, Aaron Mullins, said he had no comment.

Walsh said he found a $5 bill in the parking lot and immediately went inside and turned it over to a manager. When he went back outside — his job involved picking up garbage and collecting stray shopping carts — he found a small stack of bills, $20s and $10s, in the parking lot. It was not in an envelope and bore no identification.

He completed his task and when he got a moment, he counted the cash: $350. He stuffed it in his pants pocket. He went back inside the store, which is adjacent to a Berkshire Bank branch, and was about to turn in the bundle when he heard a commotion.

"A woman was yelling at a manager, freaking out that she lost her money and I got nervous," said Walsh, who speaks haltingly and has anxiety issues. "I kind of froze and didn't want any trouble."

Walsh returned to his job, which included cleaning the bathrooms, and he gave a manager the $350 in cash about 30 minutes after he found it. The manager took the money and Walsh heard nothing more.

Two days later, a manager showed him a surveillance tape that was time-stamped and confirmed that roughly 30 minutes elapsed from the time a camera captured Walsh's discovery of the cash and when he turned it in.

"They didn't let me explain and said they knew what happened. They told me how it happened in a way they wanted it to go," Walsh said. He was told to sign a statement, but was not given a copy. He was told to turn in his badge and his employee 10 percent discount card. He was fired for "gross misconduct."

Walsh, who has a general equivalency diploma from Mont Pleasant High School in Schenectady, worked at the Glenville Wal-Mart for 10 years and other Wal-Mart stores in the area before being shifted to the Niskayuna store. It's one-quarter the size of a standard Wal-Mart Supercenter and includes a grocery, pharmacy, deli and bakery.

"I enjoyed my job, I was a good employee and always got to work on time," he said. "I got treated like a common criminal."

In all his years as a Wal-Mart worker, including computer-based training, Walsh said he never received a handbook of employee rules or company policy about items found in the parking lot.

Walsh got a raise in September to $14.35 an hour, near a $15 cap for a maintenance worker. He was a full-time employee who worked 40 hours per week.

The timing of his firing also upset Walsh because he lost out on his 20 percent employee holiday discount and fell short of a coveted 10 percent lifetime discount card for 20-year employees.

"I was really looking forward to that lifetime discount card in two more years. They took that from me," Walsh said.

Without a paycheck, he is struggling to pay his $680 monthly rent and car payment. His wife is on disability for anxiety and depression.

"I got scared and didn't go about returning the money in the right way," he said. "I told them I was sorry. I thought they would have given me a warning or suspended me. Instead, they just fired me."

He has applied for maintenance jobs at Target, Lowe's, BJ's, ShopRite and Ellis Hospital.

Meanwhile, Smith was hired by a local property maintenance company at $12 an hour, $3 more than his Wal-Mart wage.

While this year, Walmart tied with armed forces store Exchange as the worst-rated department or discount store, in recent past years, it’s been the single worst-scoring store. In 2011, 2012 and 2013, Walmart was the single lowest-scoring department and discount store on the list — a significant departure from 10 to 15 years ago when the store ranked highly.

What’s more, Walmart has the lowest score (68 out of 100) not only among discount/department stores, but also when compared to specialty retail stores like Costco COST, , Gap GPS, , Office Depot ODP,  and Big Lots BIG, ; supermarkets; health and personal care stores and Internet retailers.

Walmart does score higher in terms of customer satisfaction than do cable companies, many airlines and health insurance companies. And the company says it is committed to improving its relationship with customers: At last year’s annual meeting, President and CEO Doug McMillon noted that one of the company’s three points to drive business going forward would be to “position ourselves to do a better job serving customers … through the combination of what we do with price, assortment, access and experience.”

Plus, a spokesperson for Walmart tells MarketWatch that there have been a number of recent steps that “demonstrate a commitment to listening to our customers,” including adding more registers during peak holiday shopping hours to save customers time last year, the introduction of the company’s Savings Catcher tool to provide consumers with additional savings and the money-back guarantee for customers “dissatisfied with less-than fresh products.”

Still, compared with its direct competitors, Walmart consistently scores low on customer love, so MarketWatch asked the experts to tell us what makes Walmart the most disliked discount/department store in the nation. Here are four reasons.

‘Low-price leader’ Walmart doesn’t always win on prices

While it’s true that you can find thousands of great deals at Walmart — and sometimes the best deals available anywhere — competitors do sometimes offer lower prices on the same or similar items these days, explains David VanAmburg, the managing director of ACSI . And consumers now know that, since it’s easy to do price comparisons these days.

So while one of the main unique selling propositions of Walmart is that it’s a low-price leader, now that it doesn’t always deliver on that promise, customers may be more dissatisfied than they were years ago, explains VanAmburg — especially considering that the shopping experience there isn’t always enjoyable. For example, if you’re looking for wrapping paper and holiday items, you’ll often find cheaper prices at dollar stores, and for books and other media, cheaper prices can often be found on Amazon.

For those set on getting the lowest price, Walmart offers a price match program, whereby if you find the price of an item you bought lower elsewhere, the store will match that price. However, there are exceptions to what prices the store will match, quantities that you can get price matches on, and other exceptions.

Good luck finding what you came in for

Will McKitterick, a retail industry analyst for IBISWorld, notes that one of the main reasons many customers dislike shopping at Walmart is that they have trouble finding what they need thanks to the fact that “some shelves aren’t stocked [correctly], items are missing, shelves are messy, merchandise may be in a different spot than last time [you shopped there].”

In other words, customers find they can’t get in and out of the store as efficiently as they’d like to — and may have to leave without grabbing all the items on their lists — he explains. This may be particularly frustrating because Walmart is, for many, a supposedly one-stop shop (a retailer, grocery store and drugstore in one) for basic household necessities. “It’s not an inviting store experience,” says Matthew Ong, a retail analyst with NerdWallet.com.

To be sure, out-of-stock shelves and missing items may be due to the fact that such items were priced so low that customers bought them out quickly, and Walmart may have changed around the placement of items in an attempt to make them easier to find.

You may get service — but don’t expect it with a smile

Walmart isn’t exactly known for its friendly and helpful employees — and that may be one of the reasons it scores low on the customer satisfaction index, says Ong. He says the customer service problems at the retailer often start with a shopper’s inability to get anyone to help them find what they need, but also includes long waits at the checkout and return lines.

Furthermore, VanAmburg points out that stores like Nordstrom JWN,   and Trader Joe’s, which consistently end up on lists of “best places to work,” also end up towards the top of customer satisfaction lists, which he says may have to do with the fact that happy employees tend to give good customer service. “The opposite is also the case,” he points out — which may explain why Walmart, which doesn’t tend to top employee satisfaction lists — may have less-than-great customer service.

Merchandise isn’t always up to snuff

While customers know that Walmart is often more about price than quality, they are still sometimes surprised (and not in a good way) about the quality of the merchandise the retailer offers, says Ong. “It has to be worth the purchase price, and customers don’t always feel that,” he says. So even if the item is only a few bucks, if it falls apart or doesn’t work well or something else goes wrong, the customer may feel that they would have been better off paying a little more elsewhere for something else that functioned better.

Walmart does sell plenty of name-brand items — and at low prices — that rank highly, and it’s now relatively easy for consumers to look up customer feedback on products before they buy (the Walmart site features customer reviews, for one).

Next time you’re chatting with a customer service agent online, be warned that the person on the other side of your conversation might see what you’re typing in real time. A reader sent us the following transcript from a conversation he had with a mattress company after the agent responded to a message he hadn’t sent yet.

Something similar recently happened to HmmDaily’s Tom Scocca. He got a detailed answer from an agent one second after he hit send.

Googling led Scocca to a live chat service that offers a feature it calls “real-time typing view” to allow agents to have their “answers prepared before the customer submits his questions.” Another live chat service, which lists McDonalds, Ikea, and Paypal as its customers, calls the same feature “message sneak peek,” saying it will allow you to “see what the visitor is typing in before they send it over.” Salesforce Live Agent also offers “sneak peak.”

On the upside, you get fast answers. On the downside, your thought process is being unknowingly observed. For the creators, this is technological magic, a deception that will result, they hope, in amazement and satisfaction. But once revealed by an agent who responds too quickly or one who responds before the question is asked, the trick falls apart, and what is left behind feels distinctly creepy, like a rabbit pulled from a hat with a broken neck. “Why give [customers] a fake ‘Send message’ button while secretly transmitting their messages all along?” asks Scocca.

This particular magic trick happens thanks to JavaScript operating in your browser and detecting what’s happening on a particular site in real time. It’s also how companies capture information you’ve entered into web forms before you’ve hit submit. Companies could lessen the creepiness by telling people their typing is seen in real time or could eliminate the send button altogether (but that would undoubtedly confuse people, as if the useless buttons in elevators to “close door” or the placebos to push at crosswalks disappeared overnight.).

Lest you think unexpected monitoring is limited to your digital interactions, know that you should be paranoid during telephone chats too. As the New York Times reported over a decade ago, during those calls where you are reassured of “being recorded for quality assurance purposes,” your conversation while on hold is recorded. So even if there is music playing, monitors may later listen to you fight with your spouse, sing a song, or swear about the agent you’re talking to. From the 2005 NYT article:

Monitoring is intended to track the performance of call center operators, but the professional snoops are inadvertently monitoring callers, too. Most callers do not realize that they may be taped even while they are on hold.

It is at these times that monitors hear husbands arguing with their wives, mothers yelling at their children, and dog owners throwing fits at disobedient pets, all when they think no one is listening.

And if there is no music playing, the agent may just have you on mute and be listening to you.

So if you don’t want to be monitored or send secret messages to agents, put your phone on mute while on hold and copy/paste messages from another document to your customer service chatbox. And in general, be nice to customer service agents. It’s not their fault.

After a hunt for PS4 controllers and Google showing wrong opening times I'm glad that I made it to the Walmart in Spring Hill Florida at 6am since the app were showing that there were 2 controllers in stock. Once I got there looking for 5 min there were, just like almost any Walmart, no controllers to be found. Manager Stephanie came then up to me offering help. After 15 min she came back with a whole cart fully stacked with new shipment boxes with all sorts of products but she thought she seen the items I was looking for. Yes she was right.... From all 4 Walmarts that I drove to on that day, the only manager who took a look even through the storage and new shipments was Manager Stephanie in Spring Hill FL. Much appreciated to save me time and more hustle finding those damn PS4 controllers.

I recently had a rather large order online and was impressed with the delivery service. I had ordered two eyeliner pencils and a lip gloss which had to be delivered separately for some reason but was surprised when I received a package with one pencil and nothing else in it. For the next two days I received a single package with only one item in it. Considering the fact that I got free delivery this must have been expensive for Walmart and I greatly appreciated receiving all the items I ordered without any trouble.

I gave them 80% because of the stores that I've gone to, and some of those stores I still do business with, is because Walmart has the best prices overall! Walmart has its own Pharmacy and Vision Center. It also has just about everything you'd need or want for your home, apartment, or business. Pets too! I almost forgot to mention the auto and garden sections! The cold and frozen food sections, have good quality products as well! It's where I do most of my shopping! Name it, and you can probably find it there, including electronics and clothes!

I love Walmart. Especially their home delivery service. I'm disabled so the home grocery delivery service is vital to me. Everything that I order is always in stock if not Walmart always make up for it with substitutes of equal price or greater value. Their prices beat their competitors. I save money every time I shop at Walmart. Not to mention they have everything I need from groceries, to clothing, to nail salon, to eye care, to restaurant subway, to hair salon, to car care. It's a one stop shopping experience and I love them because they have made my life a little easier! Thank you Walmart???

Walmart try to make their prices very competitive. I appreciate that I can buy almost all home products in a single Walmart store. I have lived in different cities and Walmart is located close to where I live thereby making it convenient enough for me to access the store. I like the new self-checkout options introduced in the store, it has reduced the queue of customers waiting to checkout. Overall, Walmart is an ideal place to shop for me to buy almost every item for my house and car and I would recommend it to anyone looking to save cost on everyday items.

Walmart has clearly sold tens of thousands of consoles to scalpers and now they are helping those scalpers resell at double the cost on the walmart marketplace site. All this during a pandemic. This seriously hurts American families, specifically their kids. Sears is doing the same thing. This is so evil, I will never shop in a Walmart again.

Went on Walmart website looking for a PS5. I know it was a long shot but thought I should give it a try. Walmart advertised they would have some available but you had to sign up for Walmart+ to be eligible. Signed up & paid & waited for the time they said it would be available. At the exact moment they said they would be available a window came on saying they were sold out and gave a timer counting down when you could add it to your cart which started at 21 minutes. My sister in another time zone was 4 minutes ahead of mine which is strange since we got the initial message at the same time. I can understand web speed etc not being exactly the same so that's fine.

The count down continued and when mine got to 1 minute it stayed for 5 minutes & then went up to 11 minutes and has counted down taking 9-10 minutes for 1 minute to come off the timer. This is just Walmart's way of scamming a bunch of people to sign up for their ** Walmart+ program when they know damn well they don't have any PS5 (in this case) or a very small number. Just another reason not to shop at Walmart or any other big chain stores! Stick with local companies who care about their community and have to look their customers in the face every day. Walmart should be ashamed of themselves!

I called Walmart for over 45 minutes and have been continuously hung up on... All I wanted was clarification; on a warranty for a Television and Sound bar I purchased which was roughly $850... Funny enough that we can spend the money and we just ignored and mistreated. Now I do not care about resolution. They need to be taught customer service or simply just fire anyone from the Tech department. Ridiculous how you can't get through to speak to an advisor from your establishment.

Do not whatsoever use their services. Go to USPS or your local bank. They will charge you so much more even when it shouldn't be that difficult and hold your money for wks. All with excuses if you can actually get in touch with them. Forget in person agencies they are useless and just one more reason not to use. Walmart they are crooks and frauds. A money order should be able to be replaced at the agency you got but at since so many identity checks are in place with not additional fee just like USPS would do. I have the original money order tab and receipt. But no. 2 days many phone calls they want me to pay over a 100 and wait weeks to get a replacement. I'm reporting to the US Fraud and Business Department. Imagine Christmas. A sick child, down a car and than what little you saved to get it now being held by a company that wants to take a big part plus maybe you get it in 30 days. I can't even.

After a hunt for PS4 controllers and Google showing wrong opening times I'm glad that I made it to the Walmart in Spring Hill Florida at food pantry nyc manhattan since the app were showing that there were 2 controllers in stock. Once I got there looking for 5 min there were, just like almost any Walmart, no controllers to be found. Manager Stephanie came then up to me offering help. After 15 min she came back with a whole cart fully stacked with new shipment boxes with all sorts of products but she thought she seen the items I was looking for. Yes she was right. From all 4 Walmarts that I drove to on that day, the only manager who took a look even through the storage and new shipments was Manager Stephanie in Spring Hill FL. Much appreciated to save me time and more hustle finding those damn PS4 controllers.

I recently had a rather large order online and was impressed with the delivery service. I had ordered two eyeliner pencils and a lip gloss which had to be delivered separately for some reason but was surprised when I received a package with one pencil and nothing else in it. For the next two days I received a single package with only metro pcs pay bill customer service item in it. Considering the fact that I got free delivery this must have been expensive for Walmart and I greatly appreciated receiving all the items I ordered without any trouble.

I gave them 80% because of the stores that I've gone to, and some of those stores I still do business with, is because Walmart has the best prices overall! Walmart has its own Pharmacy and Vision Center. It also has just about everything you'd need or want for your home, apartment, or business. Pets too! I almost forgot to mention the auto and garden sections! The cold and frozen food sections, have good quality products as well! It's where I do most of my shopping! Name it, and you can probably find it there, including electronics and clothes!

I love Walmart. Especially their home delivery service. I'm disabled so the home grocery delivery service is vital to me. Everything that I order is always in stock if not Walmart always make up for it with substitutes of equal price or greater value. Their prices beat their competitors. I save money every time I shop at Walmart. Not to mention they have everything I need from groceries, to clothing, to nail salon, to eye care, to restaurant subway, to hair salon, to car care. It's a one stop shopping experience and I love them because they have made my life a little easier! Thank you Walmart???

Walmart try to make their prices very competitive. I appreciate that I can buy almost all home products in a single Walmart store. I have lived in different cities and Walmart is located close to where I live thereby making it convenient enough for me to access the store. I like the new self-checkout options introduced in the store, it has reduced the queue of customers waiting to checkout. Overall, Walmart is an ideal place to shop for me to buy almost every item for my house and car and I would recommend it to anyone looking to save cost on everyday items.

Walmart has clearly sold tens of thousands of consoles to scalpers and now they are helping those scalpers resell at double the cost on the walmart marketplace site. All this during a pandemic. This seriously hurts American families, specifically their kids. Sears is doing the same thing. This is so evil, I will never shop in a Walmart again.

Went on Walmart website looking for a PS5. I know it was a long shot but thought I should give it a try. Walmart advertised they would have some available but you had to sign up for Walmart+ to be eligible. Signed up & paid & waited for the time they said it would be available. At the exact moment they said they would be available a window came on saying they were sold out and gave a timer counting down when you could add it to your cart which started at 21 minutes. My sister in another time zone was 4 minutes ahead of mine which is strange since we got the initial message at the same time. I can understand web speed etc not being exactly the same so that's fine.

The count down continued and when mine got to 1 minute it stayed for 5 minutes & then went up to 11 minutes and has counted down taking 9-10 minutes for 1 minute to come off the timer. This is just Walmart's way of scamming a bunch of people to sign up for their ** Walmart+ program when they know damn well they don't have any PS5 (in this case) or a very small number. Just another reason not to shop at Walmart or any other big chain stores! Stick with local companies who care about their community and have to look their customers in the face every day. Walmart should be ashamed of themselves!

I called Walmart for over 45 minutes and have been continuously hung up on. All I wanted was clarification; customer service walmart chat a warranty for a Television and Sound bar I purchased which was roughly $850. Funny enough that we can spend the money and we just ignored and mistreated. Now I do not care about resolution. They metro pcs pay bill customer service to be taught customer service or simply just fire anyone from the Tech department. Ridiculous how you can't get through to speak to an advisor from your establishment.

Do not whatsoever use their services. Go to USPS or your local bank. They will charge you so much more even when it shouldn't be that difficult and hold your money for wks. All with excuses if you can actually get in touch with them. Forget in person agencies they are useless and just one more reason not to use. Walmart they are crooks and frauds. A money order should be able to be replaced at the agency you got but at since so many identity checks are in place with not additional fee just like USPS would do. I have the original money order tab and receipt. But no. 2 days many phone calls they want me to pay over a 100 and wait weeks to get a replacement. I'm reporting to the US Fraud and Business Department. Imagine Christmas. A sick child, down a car and than what little you saved to get it now being held by a company that wants to take a big part plus maybe you get it in 30 days. I can't even.

While this year, Walmart tied with armed forces store Exchange as the worst-rated department or discount store, in recent past years, it’s been the single worst-scoring store. In 2011, 2012 and 2013, Walmart was the single lowest-scoring department and discount store on the list — a significant departure from 10 to 15 years ago when the store ranked highly.

What’s more, Walmart has the lowest score (68 out of 100) not only among discount/department stores, but also when compared to specialty retail stores like Costco M mbank login, Gap GPS, Office Depot ODP,  and Big Lots BIG, ; supermarkets; health and personal care stores and Internet retailers.

Walmart does score higher in terms of customer satisfaction than do cable companies, many airlines and health insurance companies. And the company says it is committed to improving its relationship with customers: At last year’s annual meeting, President and CEO Doug McMillon noted that one of the company’s three points to drive business going forward would be to “position ourselves to do a better job serving customers … through the combination of what we do with price, assortment, access and experience.”

Plus, a spokesperson for Walmart tells MarketWatch that there have been a number of recent steps that “demonstrate a commitment to listening to our customers,” including adding more registers during peak holiday shopping hours to save customers time last year, the introduction of the company’s Savings Catcher tool to provide consumers with additional savings and the money-back guarantee for customers “dissatisfied with less-than fresh products.”

Still, compared with its direct competitors, Walmart consistently scores low on customer love, so MarketWatch asked the experts to tell us what makes Walmart the most disliked discount/department store in the nation. Here are four reasons.

‘Low-price leader’ Walmart doesn’t always win on prices

While it’s true that you can find thousands of great deals at Walmart — and sometimes the best deals available anywhere — competitors do sometimes offer lower prices on the same or similar items these days, explains David VanAmburg, the managing director of ACSI. And consumers now know that, since it’s easy to do price comparisons these days.

So while one of the main unique selling propositions of Walmart is that it’s a low-price leader, now that it doesn’t always deliver on that promise, customers may be more dissatisfied than they were years ago, explains VanAmburg — especially considering that the shopping experience there isn’t always enjoyable. For example, if you’re looking for wrapping paper and holiday items, you’ll often find cheaper prices at dollar stores, and for books and other media, cheaper prices can often be found on Amazon.

For those set on getting the lowest price, Walmart offers a price match program, whereby if you find the price of an item you bought lower elsewhere, the store will match that price. However, there are exceptions to what prices the store will match, quantities that you can get price matches on, and other exceptions.

Good luck finding what you came in for

Will McKitterick, a retail industry analyst for IBISWorld, notes that one of the main reasons many customers dislike shopping at Walmart is that they have trouble finding what they need thanks to the fact that “some shelves aren’t stocked [correctly], items are missing, shelves are messy, merchandise may be in a different spot than last time [you shopped there].”

In other words, customers find they can’t get in and out of the store as efficiently as they’d like to — and may have to leave without grabbing all the items on their lists — he explains. This may be particularly frustrating because Walmart is, for many, a supposedly one-stop shop (a retailer, grocery store and drugstore in one) for basic household necessities. “It’s not an inviting store experience,” says Matthew Ong, a retail analyst with NerdWallet.com.

To be sure, out-of-stock shelves and missing items may be due to the fact that such items were priced so low that customers bought them out quickly, and Walmart may have changed around the placement of items in an attempt to make them easier to find.

You may get service — but don’t expect it with a smile

Walmart isn’t exactly known for its friendly and helpful employees — and that may be one of the reasons it scores low on the customer satisfaction index, says Ong. He says the customer service problems at the retailer often start with a shopper’s inability to get anyone to help them find what they need, but also includes long waits at the checkout and return lines.

Furthermore, VanAmburg points out that stores like Nordstrom JWN,   and Trader Joe’s, which consistently end up on lists of “best places to work,” also end up towards the top of customer satisfaction lists, which he says may have to do with the fact that happy employees tend to give good customer service. “The opposite is also the case,” he points out — which may explain why Walmart, which doesn’t tend to top employee satisfaction lists — may have less-than-great customer service.

Merchandise isn’t always up to snuff

While customers know that Walmart is often more about price than quality, they are still sometimes surprised (and not in a good way) about the quality of the merchandise the retailer offers, says Ong. “It has to be worth the purchase price, and customers don’t always feel that,” he says. So even if the item is only a few bucks, if it falls apart or doesn’t work well or something else goes wrong, the customer may feel that they would have been better off paying a little more elsewhere for something else that functioned better.

Walmart does sell plenty of name-brand items — and at low prices — that rank highly, and it’s now relatively easy for consumers to look up customer feedback on products before they buy (the Walmart site features customer reviews, for one).

Wal-Mart worker fired after 18 years for turning in $350 cash found in Niskayuna store parking lot too slowly

He was called into a manager's office, interrogated and terminated for "gross misconduct."

His offense? He waited about 30 minutes before he turned in the money.

"The only thing I did wrong was hesitate," Walsh said, who is 45. "I didn't steal anything. They didn't give me any warning. They just fired me."

The firing happened on the same day that Thomas Smith, 52, of Albany, an East Greenbush Wal-Mart employee, was fired for redeeming $2 worth of cans and bottles left behind in a shopping cart.

Worker rights advocates are organizing a Wal-Mart boycott through Jan. 1 and additional East Greenbush store demonstrations in response to Smith's controversial termination.

In the Niskayuna incident, a manager at the store, located on State Street in Mansion Square, said Tuesday she could not discuss Walsh's firing. A Wal-Mart spokesman, Aaron Mullins, said he had no comment.

Walsh said he found a $5 bill in marquette savings bank locations parking lot and immediately went inside and turned it over to a manager. When he went back outside — his job involved picking up garbage and collecting stray shopping carts — he found a small stack of bills, $20s and $10s, in the parking lot. It was not in an envelope and bore no identification.

He completed his task and when he got a moment, he counted the cash: $350. He stuffed it in his pants pocket. He went back inside the store, which is adjacent to a Berkshire Bank branch, and was about to turn in the bundle when he heard a commotion.

"A woman was yelling at a manager, freaking out that she lost her money and I got nervous," said Walsh, who speaks haltingly and has anxiety issues. "I kind of froze and didn't want any trouble."

Walsh returned to his job, which included cleaning the bathrooms, and he gave a manager the $350 in cash about 30 minutes after he found it. The manager took the money and Walsh heard nothing more.

Two days later, a manager showed him a surveillance tape that was time-stamped and confirmed that roughly 30 minutes elapsed from the time a camera captured Walsh's discovery of the cash and when he turned it in.

"They didn't let me explain and said they knew what happened. They told me how it happened in a way they wanted it to go," Walsh said. He was told to sign a statement, but was not given a copy. He was told to turn in his badge and his employee 10 percent discount card. He was fired for "gross misconduct."

Walsh, who has a general equivalency diploma from Mont Pleasant High School in Schenectady, worked at the Glenville Wal-Mart for 10 years san jose mercury news prop 12 other Wal-Mart stores in the area before being shifted to the Niskayuna store. It's one-quarter the size of a standard Wal-Mart Supercenter and includes a grocery, pharmacy, deli and bakery.

In all his years as a Wal-Mart worker, including computer-based training, Walsh said he never received a handbook of employee rules or company policy about items found in the parking lot.

Walsh got a raise in September to $14.35 an hour, near a $15 cap for a maintenance worker. He was a full-time employee who worked 40 hours per week.

The timing of his firing also upset Walsh because he lost out on his 20 percent employee holiday discount and fell short of a coveted 10 percent lifetime discount card for 20-year employees.

"I was really looking forward to that lifetime discount card in two more years. They took that from me," Walsh said.

Without a paycheck, he is struggling to pay his $680 monthly rent and car payment. His wife is on disability for anxiety and depression.

"I got scared and didn't go about returning the money in the right way," he said. "I told them I was sorry. I thought they would have given me a warning or suspended me. Instead, they just fired me."

He has applied for maintenance jobs at Target, Lowe's, BJ's, ShopRite and Ellis Hospital.

Meanwhile, Smith was hired by a local property maintenance company at $12 an hour, $3 more than his Wal-Mart wage.

Next time you’re chatting with a customer service agent online, be warned that the person on the other side of your conversation might see what you’re typing in real time. A reader sent us the following transcript from a conversation he had with a mattress company after the agent responded to a message he hadn’t sent yet.

Something similar recently happened to HmmDaily’s Tom Scocca. He got a detailed answer from an agent one second after he hit send.

Googling led Scocca to a live chat service that offers a feature it calls “real-time typing view” to allow agents to have their “answers prepared before the customer submits his questions.” Another live chat service, which lists McDonalds, Ikea, and Paypal as its customers, calls the same feature “message sneak peek,” saying it will allow you to “see what the visitor is typing in before they send it over.” Salesforce Live Agent also offers “sneak peak.”

On the upside, you get fast answers. On the downside, your thought process is being unknowingly observed. For the creators, this is technological magic, a deception that will result, they hope, in amazement and satisfaction. But once revealed by an agent who responds too quickly or one who responds before the question is asked, the trick falls apart, and what is left behind feels distinctly creepy, like a rabbit pulled from a hat with a broken neck. “Why give [customers] a fake ‘Send message’ button while secretly transmitting their messages all along?” asks Scocca.

This particular magic trick happens thanks to JavaScript operating in your browser and detecting what’s happening on a particular site in real time. It’s also how companies capture information you’ve entered into web forms before you’ve hit submit. Companies could lessen the creepiness by telling people their typing is seen in real time or could eliminate the send button altogether (but that would undoubtedly confuse people, as if the useless buttons in elevators to “close door” or the placebos to push at crosswalks disappeared overnight.).

Lest you think unexpected monitoring is limited to your digital interactions, know that you should be paranoid during telephone chats too. As the New York Times reported over a decade ago, during those calls where you are reassured of “being recorded for quality assurance purposes,” your conversation while on hold is recorded. It is at these times that monitors hear husbands arguing with their wives, mothers yelling at their children, and dog owners throwing fits at disobedient pets, all when they think no one is listening.

And if there is no music playing, the agent may just have you on mute and be listening to you.

So if you don’t want to be monitored or send secret messages to agents, put your phone on mute while on hold and copy/paste messages from another document to your customer service chatbox.
